We'll see. Sullivan didn't dismiss the case directly, but merely issued stays to his orders; I've seen speculation that he intends to insist on an en banc review of this order. Meanwhile, a Democratic Congressman put out a Tweet today suggesting that any judge on the circuit could (and should) request an en banc review.
We haven't gone through the riot stage of the appellate process yet, have we?

ReplyDeleteThe matter is far from settled. There's no indication it would get appealed to the the court en banc, and that outcome is far from determinate.

I suspect if the gag order falls on Flynn, all these riots will have failed to distract people from what Flynn has on Hussein or others.
ReplyDeleteGag orders are what judges use on conservatives like Tea Party. TO keep them in line while they spend years in litigation.
