State and local police in the United States will no longer be able to use federal laws to justify seizing property without evidence of a crime, U.S. Attorney General Eric Holder said on Friday.Now if we can just repeal the state laws that justify the same thing, we'll have made a real stride forward in protecting the people from the predatory aspects of the state.
I've heard that this move is to spite local law enforcement for *whatever* reason the administration has decided to spite them for.

He's not saying the feds will no longer use civil forfeiture, just that they won't share the proceeds with local and state LE.
ReplyDeleteIt's a step, because some state and local LE won't do it as much if they can't get $$$ from federal forfeiture, but it's a far cry from renunciation of civil forfeiture at the federal level. It's not about whether forfeiture will be used, it's just about who gets the money.
It's a start, at least.
