"Well, Senator, he's not supposed to be doing that."
You don't say?
"The fact is we've got people who've been held without charges for 13 years, 14 years in some cases. That's not American... that's not how we operate."
So we have heard, Secretary Kerry. I believe you prefer to kill people without charges, or trial, or evidence beyond metadata. I notice you forgot to mention the facts about how you do indeed operate, but that's understandable: there must be a dizzying lack of oxygen on your High Moral Ground.
They aren't even that. They are unlawful combatants that we have deigned to treat as EPWs in spite of the fact that they have no legal claim to the status. That status is a concession to them, made out of our interest in behaving decently to humanity.
There is no law that could be applied to them except the law of war. We have no right to enforce US Federal law on foreign nationals living in a foreign land under a foreign government's sovereignty. The laws of war are the only laws that might apply.
There was a story that Kerry, and his Senate buddy, sat around for 30 minutes as 9/11 happened, stone faced staring off into the distance, while Bush II was activating defense and shoot on target orders.
The Left is very good at projection, but it makes them predictable. 90-95% of what they accuse their enemies, was only and always and foremost true of the Leftist.
The feudal aristocrats, Christian or Muslim, had a more pragmatic system. If the person's family can pay a ransom, treat them with humility and care, as if they were a clan member. Then return them for the ransom. If the person has no family, then interrogate them when captured, then execute to free up the jail cells. Most of the time, they skipped the "capture" phase entirely.
Charges? They are EPWs. We hold them until the war is over.
